Overtime rules in Minnesota
- Live-out overtime begins after 48 hours/week.
- Live-in overtime begins after exempt under the federal default.
- Overtime multiplier: 1.5x.
Minnesota state law requires 1.5x after 48 hours weekly. Federal FLSA still applies at 40 hours for workers covered by it (most nannies).
Payroll taxes in Minnesota
Federal (applies everywhere): Social Security 6.2% and Medicare 1.45% from both employer and employee, plus FUTA at 0.6% on the first $7,000 (employer only).
Minnesota state taxes:
- State unemployment (SUTA, employer): 0.50% on the first $43,000 of wages.
- State income tax (employee, estimated effective): ~5.35%.
- Other state employer taxes: 0.70%.
- Other state employee taxes (SDI / paid leave): 0.70%.
State disability / paid leave: MN Paid Leave begins 2026: 0.7% split 50/50.
Workers' compensation in Minnesota
Required for household employees earning $1,000+ in any quarter.
